Homes & Hideaways by World of Hyatt Rules

These rules (“H&H Rules”) govern the use of the Homes & Hideaways by World of Hyatt websites, applications, and platforms (collectively, the “H&H Platform”), including the features and services made available through the H&H Platform.  

 

For information on how properties on the H&H Platform participate in World of Hyatt, please see the World of Hyatt Terms & Conditions. By using the H&H Platform, you agree to be bound by these H&H Rules and any other applicable terms and conditions, including the Hyatt Terms & Conditions available at https://help.hyatt.com/en/hyatt-terms.html and the World of Hyatt program terms available at https://help.hyatt.com/en/hyatt-terms/world-of-hyatt-terms.html (collectively, “Terms & Conditions”).

 

Capitalized terms used but not defined in these H&H Rules have the meaning ascribed to them in the Terms & Conditions. In the event of a conflict between these H&H Rules and the Terms & Conditions, these H&H Rules will govern with regard to the H&H Platform, the features and services made available through the H&H Platform, H&H Properties (as hereafter defined) and any booking or stay at, or other interaction with, such properties. Certain items, however, are only addressed in the Terms & Conditions, and, unless directly contradicted in these H&H Rules, the Terms & Conditions apply, including to those staying at any H&H Property.

 

As used throughout these H&H Rules, the terms “Hyatt,” “our,” “we,” “us,” and other similar terms may refer to one or more of Hyatt Hotels Corporation, Hyatt Corporation, Hyatt International Corporation, Select Hotels Group, LLC, and one or more of their direct or indirect subsidiaries or affiliates. These particular terms are used for convenience only and are not intended as a precise designation of any one particular entity. Such terms do not include any third party with which Hyatt works to offer any element of the H&H Platform, including but not limited to the Homes & Hideaway program or any third party that provides or owns an H&H Property.

 

The H&H Platform is intended for World of Hyatt members. If you are not a World of Hyatt member, you may enroll at Hyatt.com for free.  You may not book H&H Properties (as defined below) using the H&H Platform unless you are a World of Hyatt member in good standing.

 

PLATFORM OVERVIEW

 

The H&H Platform provides information about short term rentals (“Listings”) for homes, villas, apartments, condominiums, resorts and other accommodations that are included on the H&H Platform (each unit, an “H&H Property” and collectively, the “H&H Properties”). World of Hyatt Members must be in good standing to be eligible to book H&H Properties on the H&H Platform.

H&H Properties are operated by third-party property management companies (collectively, “Property Managers”) that will manage your booking, manage the H&H Property you book, and may provide assistance to you during your stay.  Hyatt does not manage, operate, own, lease, or control the H&H Properties or the Listings. Property Managers are responsible for the H&H Properties and the accuracy, completeness, and timeliness of their Listings.

 

H&H Properties are made available for private vacation rentals and may not be used for events, media, or any other commercial use.  All usage restrictions and prohibitions set forth in the Terms & Conditions apply to H&H Properties.

 

BOOKING OVERVIEW

 

When you book an H&H Property through the H&H Platform, you acknowledge and agree that your reservation will be directly with the Property Manager for the booked H&H Property and not with Hyatt. You further agree that your booking will be subject to the applicable H&H Property Terms and the applicable Cancellation Policy (both as hereafter defined). You also agree to pay all charges associated with your booking, including the rentals fees, any required security deposit, and any other mandatory charges or fees identified in the Listing, together with taxes associated therewith, as displayed on the H&H Platform at the time of Booking.  You acknowledge that third party service providers are used to facilitate the booking process, including, without limitation, the processing of any payments. For bookings that require a security deposit, the Property Manager is responsible for collecting and refunding the security deposit at its sole discretion.

 

When booking an H&H Property through the H&H Platform, Hyatt or the applicable Property Manager may, consistent with applicable laws, request that you provide identity verification information such as a passport or driver’s license. In some jurisdictions, Hyatt or the Property Manager may be required to collect such identity verification information and provide it to government authorities. Consistent with applicable laws, Hyatt or the applicable Property Manager may perform background checks in order to verify you or your Guests’ (as hereafter defined) identities. 

 

A booking is only valid after it is confirmed in writing via email by or on behalf of Hyatt or the applicable Property Manager. A booking of an H&H Property is a limited, revocable, nontransferable license to enter, occupy, and use the booked H&H Property during the specific stay period. You acknowledge that all H&H Properties, including booked H&H Properties, are subject to change and may be replaced or removed from the H&H Platform at any time. Subject to the terms of any agreement between you and the Property Manager, the Property Manager retains the right to re-enter the H&H Property during your stay, to the extent it is reasonably necessary and consistent with applicable law. 

 

The name on the reservation must match the name of the individual who checks-in and collects the keys or receives an access code or Property Managers may refuse access as determined in their sole discretion. Individuals under the age of 18 who are not accompanied by a legal guardian or chaperone may not occupy H&H Properties. Certain H&H Properties or Property Managers may have additional age restrictions or requirements.

 

Unless otherwise permitted under the applicable H&H Property Terms (as hereafter defined), pets are not allowed in H&H Properties. You are fully responsible for any pets that you bring on the premises.

 

H&H PROPERTY TERMS

 

In addition to these H&H Rules, you will be responsible for complying with all house rules, policies, restrictions, safety measures, standards, and other requirements identified in the Listing, during checkout, otherwise on the Platform, or available at the applicable H&H Property (“H&H Property Terms”). Without limiting any of the rights or remedies of any Property Manager or Hyatt, failure to comply with the H&H Property Terms may result in the cancellation of your booking or the immediate termination of your stay, as determined by the applicable Property Manager in Property Manager’s sole discretion. 

 

H&H Property Terms may incorporate by reference linked terms and conditions provided by the applicable Property Manager or that are provided or posted at the applicable H&H Property.  You acknowledge and agree that Hyatt is not a party to any agreement between you and any Property Manager.  You further acknowledge and agree that you may be required to enter into separate terms, agreements, or waivers in connection with booking an H&H Property through the Platform.

 

On behalf of yourself and all of your guests and each of your invitees (collectively, “Guests”), you agree to abide by the H&H Property Terms and acknowledge H&H Property Terms vary by H&H Property. If any of your Guests are minors, you warrant that you have the right and authority to act on their behalf.

 

In addition to any H&H Property Terms, you warrant on behalf of yourself and all Guests to comply with applicable laws, regulations and local ordinances, including noise restrictions, at all times while at the H&H Property. You further acknowledge and agree that occupancy beyond the maximum limit stated in the H&H Property Terms is strictly prohibited and, except as otherwise set forth in the applicable H&H Property Terms, smoking is prohibited while at the H&H Property. Without limiting any of the foregoing, you are fully responsible for all Guests and for leaving an H&H Property in the condition it was in when you arrived.

 

NOT PART OF HYATT’S BEST RATE GUARANTEE

 

Reservations for a stay at an H&H Property are not covered by or subject to Hyatt’s Best Rate Guarantee.

 

CANCELLATION

 

Prior to booking an H&H Property, please familiarize yourself with the policy for modifying or cancelling your reservation (“Cancellation Policy”). Cancellation Policies may vary by H&H Property, and you may be charged additional fees as disclosed in the applicable Cancellation Policy.  World of Hyatt cancellation benefits do not apply to H&H Properties.  You understand and agree that, from time to time, a booking may be cancelled by the applicable Property Manager and you agree to hold harmless Property Manager and Hyatt and their respective parents, subsidiaries, divisions, affiliates, agents, employees, contractors, licensees, and representatives (collectively, “Releasees”) from and against any claims arising in connection with such a cancellation. 

 

PROPERTY MANAGERS AND INFORMATION TRANSFER

 

You expressly acknowledge, on behalf of yourself and each of your Guests, that all personal information, payment information, and other information you provide on the H&H Platform may be provided to the relevant Property Manager for the booked H&H Property. You also acknowledge and agree that such Property Manager may, without limitation, share your information with third parties who perform services for them.

 

You acknowledge that Property Managers are third parties, and you agree that each Property Manager is independent from Hyatt. Hyatt is not responsible for any acts or omissions of Property Managers. See the applicable Property Manager’s privacy policy for information about their collection, sharing, and processing of personal information. 

 

RELEASE AND INDEMNITY

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, INDEMNIFY, AND HOLD THE HYATT RELEASEES HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS, OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DAMAGES, OR LOSSES TO PERSONS (INCLUDING DEATH) OR PROPERTY WHICH MAY BE SUSTAINED OR ARISE IN CONNECTION WITH: (I) YOUR BREACH OF THESE H&H RULES; (II) YOUR IMPROPER USE OF THE H&H PLATFORM; (III) YOUR AND/OR YOUR GUEST(S) STAY AT AN H&H PROPERTY; (IV) YOUR AND/OR YOUR GUEST(S) PARTICIPATING IN ANY RECREATIONAL OR OTHER ACTIVITY OFFERED OR AVAILABLE AT AN H&H PROPERTY; AND (V) ANY DISPUTE ARISING BETWEEN YOU AND ANY PROPERTY MANAGER. YOU UNDERSTAND THAT THIS PARAGRAPH WILL BIND YOUR HEIRS AND ASSIGNS.

 

GENERAL TERMS AND CONDITIONS

 

We may change or discontinue all or any part of the benefits, at any time and without notice, at our discretion as described in the Terms & Conditions. (This may include, without limitation, complete discontinuance of the Homes & Hideaway program or participation by such properties in the World of Hyatt program.) We may modify these H&H Rules from time-to-time. Hyatt will notify you of changes to the H&H Rules by posting them on the H&H Platform. The updated H&H Rules will be effective as of the time of posting, or upon such later date as specified by Hyatt. Unless otherwise stated, the updated H&H Rules will apply to your use of the H&H Platform beginning as of their effective date.
